கூர்நோக்கு இல்லங்கள் தொடர்பாக ஆய்வு மேற்கொண்ட ஒரு நபர் குழுவின் அறிக்கை / Report of a one-man committee on study of observation homes: கடந்த 2022 ஆம் ஆண்டு தாம்பரம் ரயில் நிலையத்தில் ரயில்வே துறைக்கு சொந்தமான பேட்டரியை திருடியதாக கோகுல்ஸ்ரீ என்ற சிறுவனை ரயில்வே போலீசார் கைது செய்து செங்கல்பட்டு சிறுவர் சீர்திருத்தப் பள்ளியில் ஒப்படைத்தனர்

இந்நிலையில் கடந்த 2022ம் ஆண்டு டிசம்பர் 31ம் தேதி அன்று கோகுல்ஸ்ரீ கூர்நோக்கு இல்லத்தில் மரணமடைந்தார். இந்த சம்பவத்தில் தொடர்புடைய 6 பேர் கைது செய்யப்பட்டன. 

இதனையடுத்து, இளைஞர் நீதி அமைப்பின் கீழ் செயல்பட்டுவரும் கூர்நோக்கு இல்லங்கள், சிறப்பு இல்லங்கள் மற்றும் பாதுகாப்பு இல்லங்கள் ஆகியவற்றின் செயல்பாடுகள் மற்றும் நிர்வாகத்திறன்களை மேம்படுத்தும் பொருட்டு, சென்னை உயர்நீதிமன்ற ஓய்வுபெற்ற நீதியரசர் சந்துரு தலைமையில் ஓய்வுபெற்ற இந்திய ஆட்சிப்பணி அதிகாரி மற்றும் தன்னார்வ தொண்டு நிறுவனங்களின் சார்பாக ஒரு நபர் குழு அமைக்கப்பட்டது. 

கடந்த மே மாதம் 2 ஆம் தேதி முதல் கூர்நோக்கு இல்லங்கள் தொடர்பாக ஆய்வு மேற்கொண்ட ஒரு நபர் குழு தலைவரும் ஓய்வு பெற்ற நீதியரசருமான சந்துரு இன்று தனது பரிந்துரைகள் அடங்கிய அறிக்கையை சென்னை தலைமைச் செயலத்தில் முதலமைச்சர் மு.க.ஸ்டாலினை நேரில் சந்தித்து வழங்கினார். 

பரிந்துரைகள்

கூர்நோக்கு இல்லங்கள் தொடர்பாக ஆய்வு மேற்கொண்ட ஒரு நபர் குழுவின் அறிக்கை / Report of a one-man committee on study of observation homes: 500 பக்கங்கள் கொண்ட இந்த அறிக்கையில், சமூகப் பாதுகாப்பு இயக்குநரகத்தின் கீழ் செயல்பட்டு வரும் கூர்நோக்கு இல்லங்ளை இனி குழந்தைகள் பாதுகாப்பு தொடர்பான தனி இயக்குனரகம் அமைத்து அதன் கீழ் செயல்படுத்த வேண்டும். 

ஒரு இயக்குனரின் தலைமையில் "சிறப்பு சேவைகள் துறை" (DSS) என பெயரிடப்பட வேண்டும். அவர் குழந்தை நலனுக்காக அர்ப்பணிப்புடன் செயல்படும் நபராக இருக்க வேண்டும். 

அவரது சாதாரண பதவிக்காலம் குறைந்தபட்சம் மூன்று ஆண்டுகள் இருக்க வேண்டும். இயக்குனருக்குக் கீழே, இரண்டு துணை இயக்குநர்கள் இருக்க முடியும், ஒருவர் தலைமையகத்தில் நிர்வாகப் பொறுப்பாளராகவும் மற்றவர் அனைத்து இல்லங்களுக்கும் பொறுப்பாளராகவும் இருக்கலாம். 

சிறப்பு கண்காணிப்பு அறையை உருவாக்கி இயக்குனரகம் மூலம் கூர்நோக்கு விவகாரங்கள் தினசரி கண்காணிக்கப்பட வேண்டும். காணொளி இணைப்பு மூலம் ஒவ்வொரு கூர்நோக்கு இல்லங்களில் உள்ள பிரச்சனைகளை அன்றாடம் கவனிக்க முடியும் என்று பரிந்துரைக்கப்பட்டுள்ளது.

கூர்நோக்கு இல்ல கட்டங்கள் சிறைச்சாலையை போல் இருக்க கூடாது, ஒவ்வொரு வருவாய் மாவட்டத்திலும் ஒரு கூர் நோக்கு இல்லம் அமைக்க வேண்டும், கூர்நோக்கு இல்லத்தில் உள்ள சிறுவர்களுக்கு தொழில் பயிற்சி வழங்க வேண்டும்.

கூர்நோக்கு இல்லங்களில் சிறுவர்கள் தூங்குவதற்கு மெத்தை தலையணையுடன் கூடிய கட்டில் வழங்கப்பட வேண்டும். துணிகளை துவைப்பதற்கு வாஷிங் மெஷின், கொசு விரட்டி உள்ளிட்ட வசதிகள் ஏற்படுத்தி தர வேண்டும். கூர்நோக்கு இல்லங்களில் உள்ள சிறுவர்கள் பயன்படுத்த நவீன கழிவறைகள் வசதிகள் ஏற்படுத்த வேண்டும்.

கூர்நோக்கு இல்லத்தில் உள்ள சிறுவர்களை, 24 மணி நேரமும் அறைகளில் அடைத்து வைத்திருப்பதை தவிர்க்க வேண்டும். கூர்நோக்கு இல்லங்கள் சிறைச்சாலைகள் போல இருக்கக் கூடாது. 13 வயது முதல் 16 வயது வரை உள்ள சிறுவர்கள் ஒரு குழுவாகவும் அதற்கு மேல் உள்ளவர்கள் ஒரு குழுவாகவும் அடைக்கப்பட வேண்டும்.

திறந்தவெளி அரங்கு அல்லது மூடிய அரங்குகளில் விளையாடுவதற்கு அனுமதிக்க வேண்டும். மேலும் அனைத்து கூர்நோக்கு இல்லங்களிலும், ஒரு மனநல ஆலோசகரை முழு நேரப் பணியில் அமர்த்தப்பட வேண்டும் உள்ளிட்ட பரிந்துரைகள் அடங்கியை அறிக்கை சமர்பிக்கப்பட்டுள்ளது.

Report of a one-man committee on study of observation homes: In 2022, the railway police arrested a boy named Gokulshree for stealing a battery belonging to the railway department at Tambaram railway station and handed him over to the Chengalpattu Juvenile Correctional School.

In this case, Gokulshree passed away on December 31, 2022 at Kurnokku House. 6 people involved in this incident were arrested.

Following this, in order to improve the functioning and management of the Youth Justice Homes, Special Homes and Safe Homes, a committee of retired Civil Service Officers of India and NGOs was constituted under the chairmanship of Madras High Court Retired Justice Chanduru.

Retired Justice Chanduru, who headed the one-man committee that conducted a study on the observation homes since May 2, met Chief Minister M.K.Stalin in person at the Chennai headquarters today and presented the report containing its recommendations.

Recommendations

Report of a one-man committee on study of observation homes: In the 500-page report, the observation homes, which were functioning under the Directorate of Social Welfare, should now be set up and run under a separate Directorate of Child Protection.

Headed by a Director to be named "Department of Special Services" (DSS). He should be a dedicated person working for the welfare of the child.

His normal tenure shall be at least three years. Below the Director, there can be two Deputy Directors, one in charge of administration at headquarters and the other in charge of all the houses.

A special monitoring room should be created and surveillance matters should be monitored on a daily basis by the directorate. It has been suggested that the problems in each observatory house can be observed on a daily basis through video link.

Correctional home blocks should not be like prisons, a correctional home should be established in every revenue district and vocational training should be given to boys in correctional homes.

A cot with a mattress pad should be provided for the children to sleep in the care homes. Washing machine, mosquito repellent etc. facilities should be provided for washing clothes. Modern toilets should be provided for the use of children in care homes.

24-hour confinement of children in observation homes to their rooms should be avoided. Care homes should not be like prisons. Boys between the ages of 13 and 16 should be confined in one group and those above in one group.

Play in open-air or indoor arenas should be allowed. A report has also been submitted with recommendations including the appointment of a full-time mental health consultant in all observation homes.
